Customer Terms and Conditions
1. Acceptance of Terms
By creating an account, submitting a service request, purchasing a subscription plan, purchasing a warranty plan, or otherwise using the platform, you agree to these Terms and Conditions. If you do not agree to these Terms, do not use the platform.
2. Platform Services
The platform is a software platform that connects customers with:
- Service Companies
- Independent Technicians
- Home Warranty Companies
- Maintenance Service Providers
We do not directly perform repair, maintenance, cleaning, installation, warranty, or other field services unless specifically identified as the service provider.
3. Customer Eligibility
To use the platform, you must:
- Be at least 18 years old
- Provide accurate information
- Have authority to request service for the property involved
- Comply with all applicable laws
4. Customer Account
Customers are responsible for maintaining account security, protecting passwords, updating contact information, and reporting unauthorized account access. Customers are responsible for all activities conducted through their accounts.
5. Service Requests
Customers may request services including appliance repair, HVAC, plumbing, electrical, cleaning, handyman, landscaping, and other services offered on the platform. Customers must provide accurate information regarding service needs, property location, equipment details, model and serial numbers, photos and supporting documentation.
6. Service Appointments
Appointment times are estimates. Delays may occur due to weather, traffic, or emergency situations. Neither the platform nor service providers guarantee specific arrival times.
7. Estimates and Pricing
Service costs may include diagnostic fees, service call fees, labor charges, parts charges, permit fees, taxes, subscription fees, and deductibles. Any estimate provided before diagnosis is preliminary unless specifically identified as a fixed-price service.
8. Customer Approval
Customers must approve estimates, additional labor, additional parts, and change orders. Approval may be provided electronically through the platform and is legally binding.
9. Payments
Customers authorize the platform and participating service providers to process payments using credit cards, debit cards, ACH transfers, digital wallets, or other approved payment methods such as check or cash. Customers are responsible for all approved charges.
10. Subscription Plans
Subscription fees may recur automatically. Benefits are limited to plan terms. Services not covered by the plan may incur additional charges.
11. Warranty Plans
Coverage is subject to plan terms. Exclusions may apply. Deductibles may be required. Claims may be approved or denied based on coverage rules.
12. Access to Property
Customers agree to provide safe access to the property, secure pets, disclose known hazards, and ensure authorized persons are present if required. Failure to provide access may result in additional charges.
13. Customer Responsibilities
Customers are responsible for providing accurate information, maintaining safe working conditions, following manufacturer instructions, and maintaining equipment according to applicable standards.
14. Parts and Materials
Parts availability may vary. Shipping delays may occur. Substitute parts may be used when appropriate. Manufacturer warranties may apply separately.
15. Cancellations
Customers may cancel service requests subject to cancellation fees, dispatch fees, and administrative charges.
16. No-Show Policy
If a technician arrives and cannot access the property, the customer may be charged service call fees, trip charges, or administrative fees as stated in the service provider policy.
17. Customer Reviews
Customers may submit ratings and reviews that must be truthful, based on actual experiences, and must not contain defamatory, abusive, or unlawful content.
18. Limitation of Liability
To the maximum extent permitted by law, the platform shall not be liable for service provider performance, workmanship issues, property damage, equipment failures, delays, lost profits, or consequential damages.
19. Indemnification
Customers agree to indemnify and hold the platform harmless against claims arising from false information, misuse of the platform, violations of these Terms, or unauthorized service requests.
20. Privacy
Customer information is subject to the platform's Privacy Policy and may be shared with assigned service providers, warranty companies, payment processors, and authorized third-party vendors.
21. Force Majeure
The platform shall not be responsible for delays or failures caused by natural disasters, severe weather, utility failures, government actions, labor disruptions, internet outages, or events beyond reasonable control.
22. Dispute Resolution
Customers agree to attempt good-faith resolution of disputes before initiating legal action. The platform may require mediation or arbitration where permitted by law.
23. Modifications
The platform may modify these Terms at any time. Continued use of the platform constitutes acceptance of revised Terms.
24. Governing Law
These Terms shall be governed by the laws designated by the platform in its legal documentation and platform policies.
25. Acceptance
By creating an account, requesting service, purchasing a subscription, purchasing a warranty plan, or using the platform, the customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
